2. Eligibility To rent a vehicle from Pro Active Car Rental, you must:

• Possess a valid driver's license.
• Have a valid credit card in your name.

3. Rental Period The rental period shall commence and end on the dates and times specified in the rental agreement. Late returns may incur additional charges.

4. Fees and Payments

• Rental fees are calculated based on the type of vehicle and the duration of the rental.

Car Rental Agreement for Pro Active Car Rental

Terms and Conditions:

Article I: Rental Period and Prohibited Uses

1. Rental Start and End Dates: The rental starts and ends on the dates and times specified above.
2. Vehicle Return: The customer must return the vehicle in the same condition as received, with all pertinent documents, tools, and spare tire.
3. Prohibited Uses:
   • Transporting more persons/luggage than the vehicle is equipped for.
   • Using the vehicle for purposes other than its intended use.
   • Giving driving lessons, towing other vehicles, participating in matches, tests, rallies, or allowing unauthorized persons to drive.
   • Transporting the vehicle outside of Curaçao.
   • Driving under the influence of alcohol or narcotics.

Article II: Authorized Drivers

• Only the customer and the additional driver(s) listed are authorized to drive the vehicle.
• Both are jointly liable for any damages and costs.

Article III: Odometer Acknowledgement

• The customer agrees to acknowledge the odometer reading as accurate.

Article IV: Costs and Maintenance

1. Customer Responsibility: All operational costs, including gasoline, oil, storage, and tire repairs, are the customer’s responsibility. Towing and transportation costs are also the customer’s responsibility.
2. Daily Checks: The customer must perform daily checks on oil levels, cooling water, and tire pressure. Failure to comply may result in liability for damages.
3. Unauthorized Repairs: Repairs without the lessor’s consent are at the customer’s risk and expense.

Article V: Customer Liability

1. Damage Liability: The customer is liable for all damages to the vehicle during the rental period.
2. Third-Party Damage: The customer indemnifies the lessor against any damages to passengers or third parties not covered by insurance.
3. Fines: The customer indemnifies the lessor against fines incurred during the rental period.
4. Insurance: Only third-party liability insurance with a deductible of $570 (NAf 1000) is provided. The customer is fully liable for all damages if the vehicle is used in violation of the agreement.

Article VI: Notification and Damage Handling

• The customer must notify the lessor immediately in case of damage or accident, provide a written confirmation, and follow the lessor’s instructions. All related documents must be sent to the lessor immediately.

Article VII: Lease Termination

• The lessor may terminate the lease at any time with immediate effect and repossess the vehicle if the customer fails to comply with their obligations. No refunds or indemnifications will be made.

Article VIII: Liability and Risk

• The lessor is not liable for loss or damage to property left, stored, or transported in the vehicle. The customer assumes all related risks and indemnifies the lessor against claims.

Article IX: Billing and Late Payments

1. Billing: If billed to another entity that fails to pay, the customer must pay the charges upon demand.
2. Late Payments: Late payments will incur collection charges and a 13% per annum interest rate.

Article X: Applicable Law
